Popularity makes no law invulnerable to invalidation. Americans accept judicial supervision of their democracy - judicial review of popular but possibly unconstitutional statutes - because they know that if the Constitution is truly to constitute the nation, it must trump some majority preferences.

Just as the common law derives from ancient precedents - judges' decisions - rather than statutes, baseball's codes are the game's distilled mores. The civil forfeiture law - if something so devoid of due process can be dignified as law - is an incentive for perverse behavior: Predatory government agencies get to pocket the proceeds from property they seize from Americans without even charging them with, let alone convicting them of, crimes. Criminals are treated better than this because they lose the fruits of their criminality only after being convicted.

The First Amendment...begins with the five loveliest words in the English language: 'Congress shall make no law'.

A properly functioning free market system does not spring spontaneously from society's soil as crabgrass springs from suburban lawns. Rather, it is a complex creation of laws and mores... Capitalism is a government program.
